3. General Terms and Conditions
These general terms and conditions govern the rights and obligations between Obec Test, with its registered office at Testovací 1, 512 00 Obec Test, company ID (IČO) 00000000, as the operator, and the customer (driver) when paying the parking fee via this application.
3.1 Subject and price of the service
The subject of the service is the temporary parking of a vehicle (parking fee) in the paid car parks of the operator. The price follows the price list shown in the application before the payment starts and varies by car park, vehicle type and ticket duration. The price shown is final and includes all fees - the customer pays nothing extra.
3.2 Payment terms
The parking fee can be paid by bank QR code, payment card or bank transfer. Payments are made in Czech crowns (CZK).
Demo operation: payments are only simulated, no money is transferred and no real payment service providers are involved. In live operation, online card payments are provided by a payment gateway - a licensed payment institution supervised by the Czech National Bank, with which the municipality has its own contract. Payments through the gateway are fully secured and encrypted; neither the municipality nor the application has access to payment card details. The municipality will name the specific provider here and in the footer of the application.
3.3 Terms of delivery
Parking is valid from the moment the payment is received. A confirmation showing the validity period is displayed in the application immediately after payment; we recommend saving it for later verification.
3.4 Complaints and refunds
The parking fee is a service consumed at the moment it is used; therefore, in accordance with Section 1837 of the Czech Civil Code (Act No. 89/2012 Coll.), the right to withdraw from the contract within 14 days does not apply.
We refund money in justified cases - in particular in the event of a double payment, a technical error or if parking could not be used for reasons on the part of the municipality. Please request a refund using the contact details above; the refunded amount will be sent back to the payment card or bank account from which the payment was made.
3.5 Effectiveness and governing law
These terms take effect on the day of publication. Relationships not expressly governed by these terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
4. Personal data protection
The processing of data necessary for collecting and checking the parking fee (vehicle licence plate, car park, time, amount and variable symbol) is based on the performance of a task carried out in the public interest or in the exercise of official authority (Art. 6(1)(e) GDPR) and does not require the customer's consent. Sending the payment confirmation by e-mail is voluntary and is based on consent (Art. 6(1)(a) GDPR), which the customer gives by entering an e-mail address.
Parking data (licence plate, e-mail, IP address) is automatically anonymised after 30 days - it is removed and only a record without any link to a specific person remains (variable symbol, car park, date and amount).
During parking checks, an authorised inspector may take a photograph of a vehicle without a paid parking fee as evidence of the situation found (legal basis: performance of a task carried out in the public interest, Art. 6(1)(e) GDPR). The photograph is stored outside any publicly accessible area, only the controller's authorised staff have access to it, and it is kept only for as long as necessary to deal with the matter; the retention period is set by the controller. In this demo operation, all data including photographs are deleted automatically every night.
Received bank payments are accounting documents and are kept for the period required by the Czech Accounting Act; they also contain the payer's details from the bank statement (account number and payer's name).
